Terms and Conditions for whisky bottle delivery
Legal identities of WhiskyInvestDirect and of James Eadie
WhiskyInvestDirect is a trademarked service provided by "WhiskyInvestDirect Limited" which is company number 9068458 registered in England and Wales with offices at Shortlands (7th Floor), Hammersmith, London, United Kingdom, W6 8DA.
James Eadie Limited is a subsidiary company of WhiskyInvestDirect Limited and is registered in England and Wales under number 9068458. James Eadie Limited is licensed to sell alcohol under licence 2019/00564/LAPR and has its offices at Shortlands (7th Floor), Hammersmith, London, United Kingdom, W6 8DA.
In these Terms and Conditions references to WhiskyInvestDirect mean WhiskyInvestDirect Limited wherever the context requires a legal entity; similarly, references to James Eadie mean James Eadie Limited wherever the context requires a legal entity.
Fulfilment of your order
You understand that your order will be fulfilled by WhiskyInvestDirect’s subsidiary company, James Eadie.
You permit WhiskyInvestDirect to pass the details of your order to James Eadie to enable fulfilment and to pass payment to James Eadie on your behalf.
You confirm that you have authority to provide the details submitted with the order if these details are not your own personal details.
You agree that your name and address as purchaser will be included on the packing slip and so will be available to the recipient.
Further, you allow James Eadie and its third-party providers to hold these details on its records, to process your data and to contact you regarding your order. These details may include:
- Order number provided by WhiskyInvestDirect
- Products requested
- Name of recipient
- Address of recipient
- Contact mobile number
- Contact email address
James Eadie will not use these details for marketing purposes unless separate explicit consent has been obtained. James Eadie will not sell or pass your details to any third party for marketing purposes. James Eadie will delete your personal details from its records within 10 years of last doing business with you as required by UK law.
You agree that details of the order may also be passed to James Eadie’s courier firm to allow for delivery of the order.
On placement of your order WhiskyInvestDirect will send you an email to the email address registered on your account acknowledging your order. However, this does not mean that your order has been accepted.
You understand that any product images on the website are for illustrative purposes and that the appearance of the product may vary slightly.
You conform that you are 18 years old or older.
You understand that it is illegal in the UK to buy (or attempt to buy) alcohol for anyone under the age of 18 years old. You agree that you will not attempt to order alcohol via WhiskyInvestDirect on behalf of someone under the age of 18 years old and that all deliveries will be addressed to an adult over the age of 18 years old who will be available at the given address to sign for the delivery.
Prices are in British Pounds and are inclusive of VAT, unless stated otherwise. We reserve the right to alter prices from time to time. This will not affect any orders already placed. We are not obliged to fulfil orders which have been priced incorrectly. Further, we give no warranty as to the accuracy or completeness of any information on the website.
All orders are subject to product availability.
You agree that WhiskyInvestDirect may deduct funds from the cash balance of your WhiskyInvestDirect account as payment for your order and that this sum will be taken at the point of order placement.
If your order is cancelled the appropriate funds will be returned to your WhiskyInvestDirect account.
You understand that we cannot deliver to a PO Box or Mail Box address.
You accept responsibility for delayed or failed delivery as a result of:
- incorrect or incomplete delivery details supplied by you,
- the inability to deliver to the given address following reasonable effort by our courier.
If a package is returned to James Eadie as a result of a failed delivery we reserve the right to charge your WhiskyInvestDirect account any additional shipping costs for its return and re-delivery.
You confirm that the recipient will be available to sign for the delivery at the given address. However, if an authorised person is not available to sign for delivery at the given address, you accept that our courier may have to complete the delivery by another route.
An order will be considered as delivered when:
- The order is signed for at the delivery address, or
- The order is collected from a Local Parcel Shop or Parcel Depot, or
- Our courier leaves your package in a safe place, or
- Our courier leaves your package with a neighbour.
If a package appears damaged, is leaking or appears to contain broken glass you agree not to sign for the delivery and instruct the courier to return it.
Order cancellation & returns
You may cancel your order by emailing us at email@example.com from your registered WhiskyInvestDirect email address, citing your order number, WhiskyInvestDirect username & delivery details.
If you change your mind and wish a refund, you have the legal right to cancel your order until the of the end of the day 14 days after day on which your order was delivered. (E.g. if you received your order on 1st January, you can cancel until the end of 15th January.)
If an order has already been shipped and you cancel the order, any refund will be dependent on your return of the order to us and upon our receipt of it. You must email WhiskyInvestDirect to cancel the order (details above) and then, within 14 days of notifying cancellation, return the order to James Eadie at Shortlands (7th Floor), Hammersmith, London, United Kingdom, W6 8DA
You are responsible for the cost of any returns. Furthermore, you are responsible for the safe return of your order and accept responsibility for any loss in value resulting from your handling or the actions of your agents.
Upon receipt of your returned order we will reduce (potentially to £zero) the value of that part of your refund which relates to the cost of the product (but not the part of the refund which relates to postage and packaging costs), if this has been caused by your handling it in a way that would not be permitted in a shop. For example, bottles must be returned with their seal and contents intact to be eligible for a full refund.
You accept that we will not return any funds until we receive your returned order.
If we refund you and subsequently discover that you have handled the order contents in an unacceptable way or that they have been damaged by you or your courier, you authorise us to deduct an appropriate amount from your WhiskyInvestDirect account.
WhiskyInvestDirect and James Eadie reserve the right to cancel an order and return the original sum taken to your WhiskyInvestDirect account.
No interest will be paid on funds during the period that they were held by WhiskyInvestDirect or by James Eadie.
We will make refunds to your WhiskyInvestDirect account in a timely fashion.
This does not affect your statutory rights.
Responsibilities & liabilities
All products sold are for domestic and personal use only. You will not use them for commercial business or re-sale purposes.
We are not responsible for loss or damage caused by ignoring product warnings shown on our merchandise.
If you breach the law or our terms and conditions as part of your order, you will pay WhiskyInvesDirect and James Eadie reasonable compensation for the net costs incurred by them.
WhiskyInvestDirect and James Eadie's total liability to you arising in connection with the performance or contemplated performance of these Terms and Conditions shall be limited to the value of your order(s) for bottle delivery under these Terms & Conditions.
WhiskyInvestDirect and James Eadie shall not be liable to you for any claims of compensation either direct, indirect or consequential whatsoever (howsoever caused), which arise out of or in connection with these Terms and Conditions.
Neither WhiskyInvestDirect nor James Eadie shall be liable to you for any delay or failure by it to perform its obligations if such delay or failure arises from any unforeseeable causes beyond its reasonable control including, but not limited to, acts of God, floods, lightning, earthquakes, labour disputes, shortages, rationing, utility failures, war, terrorism, riot, embargoes, and actions of any government agency or subdivision thereof.
The law governing the provision of this bottle delivery service is the law of England & Wales and any disputes arising in respect hereof shall be governed exclusively by the English courts.
